ORDINANCE NO. 2008-4 AN ORDINANCE AMENDING CHAPTER 10.14.010 OF THE
PREAMBLE WHEREAS, this Ordinance is for the purpose of adopting regulations governing parking and display for sale of motor vehicles, including boats and other recreational vehicles, campers, trailers and goods, within the City; and WHEREAS, the Mayor and City Council of the City of Richfield have examined proposed amendments as approved and submitted by the Planning Commission and have determined those proposals to be in the best interest of the City and the best interest of the citizens, inhabitants, owners, occupants or users of property within the City; now therefore, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
SECTION 1. Preamble: The recitals in the Preamble are enacted to be deemed a part of this Ordinance and are hereby declared to express the intent hereof. SECTION 2. Title 10, of the Richfield Municipal Code is hereby amended by the City Council to include the following: Section 10.14.010 is hereby added to read as follows: 10.14.010 Parking and display for sale of motor vehicles, including boats and other recreational vehicles, campers, trailers and goods, within City limits. A. It shall be unlawful to park and display for sale any motor vehicle, including boats and other recreational vehicles, campers, trailers and goods, for the purpose of displaying the same for sale on any unimproved and unpaved lot. This ordinance shall not apply to a person displaying one (1) motor vehicle, trailer, camper or the like for sale if owned by such person and displayed on the residential property then occupied by such person as its owner or lawful tenant. Nor does this ordinance apply to the use of residential property for an occasional garage sale event. B. For purposes of this section, an unimproved and unpaved lot shall be defined as a surface lacking asphalt, cement or other binder pavement providing a dustless surface. C. A citation shall be issued to the registered owner of such motor vehicle, camper, trailer and the owner shall be presumed to be the responsible person. D. Nothing herein shall prevent the issuance by the City of temporary and seasonal permits under Chapter 13 of the Land Use Ordinance of Richfield City. E. Violation of this ordinance shall constitute an infraction and each day during which an offense occurs or continues shall be deemed a separate offense. SECTION 3. No other sections or provisions of the Land Use Management and Development Code shall be effected. SECTION 4. Effective Date. This Ordinance shall become effective immediately upon adoption, posting and publication of a Summary in The Richfield Reaper as provided in ยง10-3-711, Utah Code Annotated 1953, as amended.
